1. Introduction and seller information

These Terms of Use govern your use of BeforeSend AI, an AI-assisted reply drafting service provided by Martin Vladimirov Nikolov, trading as BeforeSend AI (“we”, “us”, “our”). By accessing or using the service, you agree to be bound by these terms. If you do not agree, please do not use the service.

2. Description of the service

BeforeSend AI helps users draft natural replies to chat messages, emails, or other short conversational inputs. You may upload a screenshot or paste text, choose a situation, goal, tone, length, and emoji preference, and receive up to three suggested replies.

3. Eligibility and authority

You must be at least 18 years old to use the service. If you use it on behalf of an organization, you represent that you have authority to bind that organization to these terms.

4. Account and credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and keep it updated.

5. Acceptable use

You agree not to misuse the service. Prohibited conduct includes, but is not limited to: unlawful use; fraud, spam, or impersonation; infringement of intellectual property or other rights; interference with service security; distribution of malware; scraping or reverse engineering; generating content that is abusive, hateful, harassing, threatening, sexually explicit involving minors, or otherwise harmful.

As a generative AI tool, BeforeSend AI must be used responsibly. You are solely responsible for the prompts you submit, how you use the generated replies, and verifying the accuracy and appropriateness of outputs before sending them. Outputs may be inaccurate and are not suitable for regulated professional advice without human oversight.

6. User content

You retain ownership of the text and screenshots you submit. You grant us a limited license to process them solely to provide the service. We do not intentionally store screenshots or conversation content after processing.

7. Intellectual property

We retain ownership of the service, its software, documentation, branding, and all related intellectual property. Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the service for your personal or internal business purposes.

8. Restrictions

You may not reverse engineer, decompile, circumvent technical limits, resell, redistribute, or commercially exploit the service without our written consent.

9. Service level

We do not guarantee that the service will be uninterrupted, error-free, or available at all times. Features and limits may change.

10. Payments, subscriptions and taxes

Paid plans and credit packs are processed by Paddle, our online reseller and Merchant of Record. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Subscriptions renew automatically until canceled. You can cancel anytime from your account settings or Paddle customer portal. Prices are inclusive of applicable taxes where required. By purchasing, you also agree to Paddle's Buyer Terms.

11. Refund policy

We offer a 30-day money-back guarantee. If you are not satisfied with your purchase, you may request a full refund within 30 days of your order date. Refunds are processed by Paddle. To request a refund, visit paddle.net or contact us at support@beforesend.ai. See our Refund Policy for details.

12. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations.

13. Consequences of termination

Upon termination, your right to use the service ceases immediately. We may delete or anonymize your data in accordance with our Privacy Policy and applicable law.

14. Warranties disclaimer

The service is provided “as is” without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

15. Limitation of liability

To the fullest extent permitted by law, our aggregate liability is limited to the total fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, incidental, or special damages, including loss of profits, data, or goodwill, except where liability cannot be excluded by law (such as fraud, death, or personal injury).

16. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these terms.

17. Governing law and disputes

These terms are governed by the laws of the Republic of Bulgaria. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts of Sofia, Bulgaria, unless mandatory local law requires otherwise.

18. Changes to these terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the revised terms.
